नई दिल्ली: झारखंड सरकार का आरोप है कि केंद्र सरकार ने झारखंड राज्य सरकार से परामर्श के बिना ही राज्य की कोयला खदानों की निलामी की एकतरफा घोषणा की है.झारखंड राज्य की कोयला खदानों की निलामी के केंद्र सरकार के फैसले को राज्य सरकार ने सुप्रीम कोर्ट में चुनौती दी है.
राज्य सरकार ने संविधान के अनुच्छेद 131 के तहत केंद्र सरकार के खिलाफ याचिका दायर की है. बताते चलें कि केंद्र के साथ विवाद होने पर राज्य सरकार इसी अनुच्छेद के तहत सीधे सुप्रीम कोर्ट में मामला दायर कर सकते हैं. इससे पहले पिछले महीने झारखंड सरकार ने राज्य की 41 कोयला खदानों के खनन के लिए डिजिटल नीलामी प्रक्रिया की केंद्र सरकार की कार्रवाई के खिलाफ सुप्रीम कोर्ट में याचिका दायर की थी.
याचिका में आगे कहा गया है कि केन्द्र सरकार ने राज्य सरकार से परामर्श के बगैर ही नीलामी की एकतरफा घोषणा की है. राज्य सरकार उसकी सीमा के भीतर स्थित इन खदानों और खनिज संपदा की मालिक है. आगे लिखा है कि फरवरी, 2020 की बैठक का कोई मतलब नहीं है, क्योंकि इसमें कोविड-19 की वजह से बदली हुए परिस्थितियों को ध्यान में नहीं रखा गया है. कोविड-19 महामारी, जिसने देश को ही नहीं, बल्कि पूरे विश्व में अभूतपर्वू ठहराव ला दिया है.

याचिका में कहा गया है कि 5 और 23 फरवरी को हुई बैठकों का जिक्र करते हुए कहा गया है कि केंद्र ने राज्य द्वारा उठायी गयी आपत्तियों पर विचार नहीं किया है. इसी तरह वाद में संविधान की पांचवीं अनुसूची का जिक्र करते हुए कहा गया है कि झारखंड में नौ कोयला खदानों में से छह (चकला, चितरपुर, उत्तरी ढाडू, राजहरा उत्तर, सेरगढ़ और उर्मा पहाड़ीटोला), जिन्हें नीलामी के लिए रखा गया है, पांचवीं अनुसूची के इलाके हैं. वाद के अनुसार, झारखंड में 29.4 प्रतिशत वन क्षेत्र है और नीलामी के लिए रखी गयी कोयला खदानें वन भूमि पर हैं. इसमें आगे कहा गया गया है कि इस समय कोयला खदानों की नीलामी का मतलब राष्ट्रीय हित की कीमत पर पूंजीवादी लॉबी के हाथों में खेलना होगा.
