पिता-पुत्र के आय से अधिक संपत्ति मामले में CBI को SC का नोटिस

नई दिल्ली। आय से अधिक संपत्ति अर्जित करने के मामले में उच्चतम न्यायालय ने सोमवार को सपा नेता मुलायम सिंह यादव और उनके बेटों अखिलेश यादव एवं प्रतीक यादव के खिलाफ अर्जी पर सीबीआई को नोटिस जारी किया है। च्चतम न्यायालय ने सोमवार को आय से अधिक संपत्ति अर्जित करने के मामले में सपा नेता मुलायम सिंह यादव और उनके बेटों अखिलेश यादव एवं प्रतीक यादव के खिलाफ अर्जी पर सीबीआई को नोटिस जारी किया है।

मुख्य न्यायाधीश रंजन गोगोई और न्यायमूर्ति दीपक गुप्ता की पीठ ने सीबीआई को इस मामले में जांच की स्थिति बताने के लिए 2 सप्ताह का समय दिया है। पीठ कांग्रेस नेता विश्वनाथ चतुर्वेदी की उस याचिका पर सुनवाई कर रही थी, जिसमें सीबीआई को मामले की जांच की स्थिति अदालत को बताने के लिए निर्देश देने का अनुरोध किया गया।

ज्ञात हो कि चतुर्वेदी ने 2005 में याचिका दायर करके शीर्ष अदालत से आग्रह किया था कि वह मुलायम सिंह यादव, अखिलेश यादव, उनकी पत्नी डिंपल यादव और प्रतीक यादव के खिलाफ भ्रष्टाचार निरोधक कानून के तहत मुकदमा चलाने का निर्देश दे।

शीर्ष अदालत ने एक मार्च 2007 को अपने फैसले में सीबीआई को आरोपों की जांच करने तथा यह पता लगाने का निर्देश दिया था कि सपा नेताओं की आय से अधिक संपत्ति से संबंधित याचिका सही है या नहीं। अदालत ने 2012 में मुलायम और उनके बेटों की इस फैसले के खिलाफ पुनर्विचार याचिकाओं को खारिज कर दिया था और सीबीआई को इस मामले की जांच के क्रम में आगे बढ़ने का निर्देश दिया था।

न्यायालय ने सीबीआई को जांच का आदेश दिया था, जिसके खिलाफ इन सभी ने पुनर्विचार याचिका दायर की थी, हालांकि न्यायालय ने डिंपल यादव की याचिका मंजूर कर ली थी और सीबीआई को उनके खिलाफ जांच रोकने को कहा था। न्यायालय ने कहा था कि वह कोई सार्वजनिक पद पर नहीं हैं।

अदालत ने एक मार्च 2007 के अपने आदेश में संशोधन कर सीबीआई से सरकार के सामने नहीं बल्कि अदालत के सामने स्थिति रिपोर्ट पेश करने को कहा था। चतुर्वेदी ने अपनी नई याचिका में कहा कि शिकायत दर्ज होने, अदालत के निर्देश और इस संबंध में एक नियमित मामला दर्ज होने में अनिर्णय के बीच लंबा अंतराल रहा और 11 साल से इस मामले में किसी कार्रवाई के बिना असामान्य लंबा वक्त गुजर चुका है।

नियमित मामला दर्ज करने के लिए यह विषय अब भी सीबीआई के सामने लंबित है। याचिका में कहा गया कि अब तक मुलायम-अखिलेश के खिलाफ कोई प्राथमिकी दर्ज नहीं हुई और इससे न केवल पूरे मामले को अपूरणीय क्षति पहुंची बल्कि यह हमारी जांच एजेंसियों की विश्वसनीयता एवं ईमानदारी पर गंभीर सवाल उठे हैं।

इस याचिका में कहा गया कि सीबीआई कानून के अनुसार नियमित मामला दर्ज करने तथा क्षेत्राधिकार वाले मजिस्ट्रेट को प्राथमिकी की रिपोर्ट देने के लिए बाध्य है। सीबीआई की पिछली स्थिति रिपोर्ट के संदर्भ में, दर्ज की गई नई याचिका में कहा गया कि इससे संकेत मिलते हैं कि न केवल मुलायम, अखिलेश और प्रतीक ने बल्कि डिंपल ने भी आय से अधिक संपत्ति अर्जित की। इसके अलावा इसमें आयकर रिटर्न और यादव परिवार के विश्वसनीय दस्तावेजों के आधार पर आय से अधिक संपत्ति करीब 2।63 करोड़ रुपये आंकी गई है।
