नई दिल्ली । अयोध्या विवाद पर सुप्रीम कोर्ट के फैसले के खिलाफ शुक्रवार को ऑल इंडिया मुस्लिम पर्सनल लॉ बोर्ड के समर्थन से 5 पुनर्विचार याचिकाएं दायर की गईं। ये याचिकाएं मुफ्ती हसबुल्लाह, मौलाना महफुजुर रहमान, मिस्बाहउद्दीन, मोहम्मद उमर और हाजी महबूब की तरफ से दाखिल की गई हैं। इससे पहले जमीयत उलेमा-ए-हिंद के अध्यक्ष मौलाना सैयद अरशद रशिदी भी रिव्यू पिटीशन दाखिल कर चुके हैं। किसी भी फैसले के खिलाफ रिव्यू पिटीशन दाखिल करने के लिए कई नियम होते हैं, जिन्हें जानने के लिए भास्कर APP ने सुप्रीम कोर्ट के वकील और ‘अयोध्याज राम टेम्पल इन कोर्ट्स’ पुस्तक के लेखक विराग गुप्ता से बात की।

पुनर्विचार याचिका पर क्या कहता है कानून
संविधान के अनुच्छेद 141 के तहत सुप्रीम कोर्ट के फैसले देश का कानून माने जाते हैं और उनके खिलाफ अपील का कोई प्रावधान नहीं है। लेकिन फिर भी, अगर फैसले में कोई गलती है या टाइपिंग मिस्टेक है या फिर तथ्यात्मक गलती है, तो उसे सुधारने के लिए अनुच्छेद 137 के तहत रिव्यू पिटीशन या पुनर्विचार याचिका दायर की जा सकती है।

फैसला आने के बाद कितने दिनों तक रिव्यू पिटीशन दाखिल कर सकते हैं
सुप्रीम कोर्ट के नियमों के अनुसार, फैसला आने के 30 दिन के भीतर रिव्यू पिटीशन दाखिल की जा सकती है। लेकिन, सुप्रीम कोर्ट कुछ विशेष परिस्थितियों में 30 दिन बाद दाखिल हुई रिव्यू पिटीशन पर भी विचार कर सकती है। हालांकि, देरी से दाखिल करने का कारण बताना जरूरी होता है। इसके साथ ही रिव्यू पिटीशन पर एडवोकेट ऑन रिकॉर्ड (एआर) का सर्टिफिकेट भी होना चाहिए।

क्या कोई भी रिव्यू पिटीशन दाखिल कर सकता है
हां, कोई भी व्यक्ति रिव्यू पिटीशन दायर कर सकता है। लेकिन, कानून का गलत इस्तेमाल करने वालों के खिलाफ कोर्ट उसपर जुर्माना भी लगा सकती है।

क्या रिव्यू पिटीशन पर वही जज सुनवाई करते हैं, जिन्होंने फैसला दिया है
फैसले की गलतियों को वही बेंच समझ सकती है, जिसने फैसला दिया है। इसलिए नियम और परंपरा के अनुसार, फैसला देने वाली बेंच ही रिव्यू पर सुनवाई करती है। अगर फैसला देने वाली बेंच का कोई जज रिटायर हो जाए तो उनकी जगह नए जज को शामिल किया जाता है। अब अयोध्या मामले पर फैसला देने वाली बेंच में से पूर्व चीफ जस्टिस रंजन गोगोई रिटायर हो गए हैं। इसलिए नए चीफ जस्टिस एसए बोबड़े उनकी जगह किसी दूसरे जज को बेंच में शामिल करेंगे।

रिव्यू पिटीशन खारिज हो गई तो मस्जिद की जमीन का क्या होगा
सुप्रीम कोर्ट ने सुन्नी वक्फ बोर्ड को मस्जिद के लिए अयोध्या के किसी प्रमुख स्थान पर 5 एकड़ जमीन देने का आदेश दिया है। अगर कोर्ट रिव्यू पिटीशन खारिज भी कर देती है, तो भी सुन्नी वक्फ बोर्ड को मिली 5 एकड़ जमीन पर कोई प्रभाव नहीं पड़ेगा। यानी, सुन्नी वक्फ बोर्ड को 5 एकड़ की जमीन मिलेगी ही।

रिव्यू पिटीशन खारिज होने के बाद भी क्या कोई विकल्प है
ऐसा होने पर याचिकाकर्ता के पास क्यूरेटिव पिटीशन दाखिल करने का भी अधिकार होता है, लेकिन इसमें याचिकाकर्ता को बताना होता है कि वह किस आधार पर सुप्रीम कोर्ट के रिव्यू के फैसले को चुनौती दे रहा है। इसे दाखिल करने के लिए एडवोकेट ऑन रिकॉर्ड (एआर) के साथ-साथ सीनियर एडवोकेट का सर्टिफिकेट भी जरूरी होता है। क्यूरेटिव पिटीशन दाखिल करने की कोई समय सीमा तय नहीं है। क्यूरेटिव पिटीशन को फैसला देने वाले जजों के अलावा सुप्रीम कोर्ट के तीन सबसे सीनियर जजों के पास भी भेजा जाता है और यह सभी इस पर विचार करते हैं।

क्या रिव्यू पर सुनवाई के दौरान फैसले पर स्टे लग जाता है
रिव्यू पिटीशन पर सुनवाई के दौरान भी फैसले पर स्टे तब तक नहीं लगाया जाता, जब तक कोर्ट फैसले पर रोक की बात नहीं कहती। इसलिए उसका पालन किया जाएगा। अयोध्या मामले में कोर्ट ने केंद्र सरकार को आदेश दिए हैं, इसलिए उनके पालन कराने की जिम्मेदार केंद्र सरकार की है। अब सरकार को ही अगर मामला टालना हो तो कह सकती है कि कोर्ट में मामला पेंडिंग है
