नई दिल्ली। अनुच्छेद 370 के अधिकांश प्रावधान खत्म करने के बाद लगाए गए प्रतिबंधों पर सुप्रीम कोर्ट द्वारा जम्मू-कश्मीर प्रशासन को एक हफ्ते के अंदर समीक्षा करने को कहा गया है।सुप्रीम कोर्ट को दी गयी कई याचिकाओं जिनमे कांग्रेस के नेता गुलाम नबी आजाद और अन्य पर सुनवाई करते हुए देश की सबसे बड़ी अदालत ने जम्मू-कश्मीर प्रशासन से बैंकिंग, अस्पताल, शिक्षण संस्थानों समेत सभी जरूरी सेवाएं देने वाले संस्थानों में इंटरनेट सेवा बहाल करने का आदेश दिया है। कोर्ट ने अपने आदेश मैं साफ कहा कि इंटरनेट को सरकार अनिश्चितकाल के लिए बंद नहीं कर सकती। कोर्ट ने इंटरनेट के इस्तेमाल को अभिव्यक्ति के अधिकार का हिस्सा माना है।
तीन सदस्यीय बेंच जिनमे स्टिस एनवी रमण, जस्टिस आर सुभाष रेड्डी और जस्टिस बीआर गवई का भी मानना है की लोगों को असहमति जताने का पूरा अधिकार है। धारा 144 का जिक्र करते हुए सुप्रीम कोर्ट ने कहा कि इसका इस्तेमाल सोच-विचार कर ही किया जाना चाहिए।इसका दुरुपयोग विरोधी विचार को कुचलने के औजार के तौर पर न किया जाए । सुप्रीम कोर्ट ने जरूरी सेवाओं के इस्तेमाल के लिए इंटरनेट की बहाली का भी आदेष दिया । कोर्ट ने कहा, ‘इंटरनेट का इस्तेमाल संविधान के आर्टिकल 19 के तहत दिए गए अधिकार के तहत ही है।
सुप्रीम कोर्ट के आदेश की मुख्य बातें
1-लोगों को असहमति जताने का पूरा अधिकार
2-सरकार अपने सभी आदेशों की 1 हफ्ते में समीक्षा करे
3-सरकार कश्मीर में अपने गैरजरूरी आदेश वापस ले
4-बैन से सभी जुड़े आदेशों को सरकार सार्वजनिक करे
5-आदेशों की बीच-बीच में समीक्षा की जानी चाहिए
6-बिना वजह इंटरनेट पर बैन नहीं लगाया जा सकता
7-इंटरनेट बैन पर सरकार को विचार करना चाहिए
8-इंटरनेट पर पूरा बैन सख्त कदम, जरूरी होने पर लगे
9-सभी जरूरी सेवाओं में इंटरनेट को बहाल किया जाए
10-चिकित्सा जैसी सभी जरूरी सेवाओं में कोई बाधा न आए
नागरिकों के अधिकारों की रक्षा एवं स्वतंत्रता भी जरूरी :सुप्रीम कोर्ट
सुप्रीम कोर्ट ने कहा नागरिकों के अधिकारों की रक्षा और सुरक्षा में संतुलन बनाए रखना होग। जरूरत पड़ने पर ही इंटरनेट को बंद किया जाना चाहिए। कोर्ट ने कहा कि अभिव्यक्ति की स्वतंत्रता लोकतंत्र का अंग है। आर्टिकल 19 (1)इंटरनेट इस्तेमाल की स्वतंत्रता का ही हिस्सा है। कोर्ट ने यह भी कहा कि धारा 144 का इस्तेमाल किसी के विचारों को दबाने के लिए नहीं किया जा सकता।
बता दें कि जम्मू कश्मीर में प्रतिबंधों को चुनौती देने वाली याचिकाओं पर सुप्रीम कोर्ट ने पिछले साल 27 नवंबर को सुनवाई पूरी की थी। केंद्र सरकार ने जम्मू-कश्मीर को विशेष राज्य का दर्जा प्रदान करने वाले संविधान के अनुच्छेद 370 के अधिकांश प्रावधान समाप्त करने के बाद वहां लगाए गए प्रतिबंधों को 21 नवंबर को सही ठहराया था। केंद्र ने न्यायालय में कहा था कि सरकार के एहतियाती उपायों की वजह से ही राज्य में किसी व्यक्ति की न तो जान गई और न ही एक भी गोली चलानी पड़ी।
गुलाम नबी आजाद के अलावा, कश्मीर टाइम्स की कार्यकारी संपादक अनुराधा भसीन और कई अन्य ने घाटी में संचार व्यवस्था ठप होने सहित अनेक प्रतिबंधों को चुनौती देते हुए याचिकाएं दायर की थीं। केंद्र ने कश्मीर घाटी में आतंकी हिंसा का हवाला देते हुए कहा था कि कई सालों से सीमा पार से आतंकवादियों को यहां भेजा जाता था, स्थानीय उग्रवादी और अलगावादी संगठनों ने पूरे क्षेत्र को बंधक बना रखा था और ऐसी स्थिति में अगर सरकार नागरिकों की सुरक्षा के लिए एहतियाती कदम नहीं उठाती तो यह ‘मूर्खता’ होती। केंद्र सरकार ने पिछले साल पांच अगस्त को जम्मू कश्मीर को विशेष राज्य का दर्जा देने वाले संविधान के अनुच्छेद 370 के अनेक प्रावधान खत्म कर दिए थे।
